We Help Fathers Obtain Legal Rights Through Legitimation

Child Custody and Visitation

Georgia law can be difficult on unmarried fathers. While state law places obligations and responsibilities on biological fathers, including for child support, it only grants custody rights to the biological mother. The only way an unmarried father can obtain legal custody is through legitimation. This is true even if the father is listed on the birth certificate.

Giving Fathers The Benefits Associated With Legal Fatherhood

Fathers are vital to the development of children. However, without legal recognition of fatherhood, the right to regularly see your child may be in jeopardy, despite having to pay a significant amount of child support. Through legitimation, fathers can:

  • Obtain sole or joint physical custody (meaning the child can live with you)
  • Have legal rights involving inheritance laws, Social Security eligibility, and other financial benefits

Our lawyers can discuss with you the benefits of legitimation and how it may benefit you according to your individual circumstances. Keep in mind that legitimation is separate from paternity. For more information about paternity, follow this link.
